Conflicts of Interest

We would have a non-disclosure agreement in place that defines confidential information you supply to me, how I may use it, and often how it is dealt with at the end of the contract.


Working for a Competitor?

It should be noted that duty to not work for a competitor is not a permissible element of an independent contractor contract in Massachusetts, and such a contract term may be grounds for a regulatory finding that the contractor is in fact an employee. Massachusetts law and jurisdiction will be implicated when either party is in Massachusetts or any part of the work is performed in Massachusetts, even if the contract is explicit that the laws or another state control, and Massachusetts regulators do perform compliance audits to hit employers with fines and refer to the IRS for back taxes. Any term that would create such a duty must be avoided.


Former employers

 

I'm bound by confidentiality agreements with my former employers.

I can direct you to publicly available information on those companies and their products - on their web sites, publications presentations, etc.  


Other Consultants

I am in contact with former colleagues who have specific expertise in areas like chemometrics, electrical engineering, setting up sales organizations, etc.  I can refer you to these, if interested.
